Those who are considering surrogacy as their road to parenthood are inevitably faced with some difficult challenges – medical, ethical, financial, and often legal challenges as well. Surrogacy is complex enough in the United States, where it is unregulated in many states and has legal restrictions in others. An increasing number of those who are hoping to become parents but cannot become pregnant or carry a pregnancy to full term for whatever reason are turning to fertility tourism, and Indian surrogacy arrangements in particular.
Commercial surrogacy is permitted in India and even encouraged by authorities. Finding an egg donors, potential surrogate mothers and fertility clinics is not very difficult in India, and specialized legal services are available. The quick availability of surrogates and a relatively low costs are the main advantages of Indian surrogacy. But if you thought that these seemingly very favorable circumstances make for clear sailing, you could be wrong. (more…)

Numerous Americans have been arrested abroad for behaviors that they did not realize were considered crimes. Others were punished harshly for a crime that would result in a mere slap on the wrist in the United States. The most famous example of this situation is the 18-year-old Michael Fay, whose vandalism of Singapore property was rewarded with a flogging in 1994. You may always hear about a lawsuit being brought to the court. You may also have an idea about what it is. But how does a lawsuit begin? A lawsuit is an action, usually civil in nature, in which an injury is made by a party, which is called the defendant to another party which is called the plaintiff. Usually, a lawsuit is brought to the court by the plaintiff to seek an equitable remedy or justice. This means that the rights of this party are being offended by the other party or the defendant. Estate planning can be an extremely emotional process. It requires us to directly acknowledge the fact of our own mortality.
