Have Sexual Offenders Found a Way around Megan’s Law? If so, People’s Faith in Our Legal System Is Doomed.

The Recorder recently reported that a sexual offender filed a claim that has reached the Ninth Circuit U.S. Court of Appeals. The offender’s claim is twofold. First, he claims that having his name published as a sexual offender on California’s Megan’s Law website is a threat to his safety and emotional well-being. Additionally, he claims that when he pled guilty in the early 90s, Megan’s law was not in place. So, by publishing his name on the Megan’s Law website, the terms of his plea bargain, which made registration information confidential, are being violated. (more…)

Arizona state legislators recently proposed a measure that would require hospital personnel to report illegal immigrants to federal officials. Some argue that such a measure is cruel because seriously injured illegal immigrants would avoid hospitals for fear of deportation / removal. Others support this measure on the basis of taxpayer fairness; that limited hospital resources are being used as a primary healthcare option for illegal immigrants instead of emergency care for those taxpayers in need. In an effort to halt what was described as the beginnings of an epidemic by attorneys, judge W. Douglas Baird found that it is illegal for debt collection and credit recovery agencies to use social media sites such as FaceBook to hunt down and harass people who owe them or their client’s money.

Most people usually engage in contracts. These contracts may be a contract for a job employment or a contract to enter into business with another person or a contract to join an organization. Contract is an overused word nowadays especially in business dealings. But what makes a contract solid?

Contract is simply not just an agreement between two parties. It is an obligation of both parties to do or not to do. A contract is actually the instrument which binds these two parties. A contract, to be valid, must have a mutual consent between the two parties. (more…)

A tort law can also be translated as the law governing the crimes or wrongdoings of the citizens. It does not arise from contractual obligations. It must not also be confused to arise with quasi-tort obligations. You must take note that the tort law does not govern the breach arising from not fulfilling the obligation from a contract.

The same is true for quasi-tort obligations. Usually, quasi-tort obligations arise from negligence. If a person has unintentionally broken your window from playing baseball, it is going to result in a quasi-tort obligation. (more…)

A state law is a separate law of a certain state or region of a country. This state law must comply with the constitution of a country. State laws must be passed by the legislative body or the legislature to the judicial body for a formal judging of the court.

Since a state law varies from region to region, there is also a variation of its characteristics and the corresponding punishment for its violation. In, the United States, a state law may vary from the state of Florida from the other states. The same is applicable for any other country, whatever form of government it has. (more…)
